After years of deliberation, on 10 June 2020, Indonesia enacted Law No. 3 of 2020 regarding the amendments of Law No. 4 of 2009 regarding Minerals and Coal Mining. The issuance of the amendments was initiated by the Indonesian House of Representatives on 17 December 2019 after Indian Metals Ferro Alloys (“IMFA”) claimed that Indonesia did faulty on the Indonesia – India Bilateral Investment Treaty (“BIT”).
Our Partner, Narada Kumara and Associate Naila Sjarif, outline the context of IMFA’s claims on Indonesia’s violation of the BIT and explain why Indonesia is not deemed as faulty as alleged by IMFA.
