How is Land Relinquished to the State?

The legal basis for relinquishing land rights, including ownership rights, cultivation rights, and building use rights, can be found in Article 27, Article 34, and Article 40 of the Law on Basic Agrarian Principles (“Agrarian Law”). The definition of relinquishment of rights can be found in Article 1 number 11 of GR No. 39 of 2023, where it is defined as the termination of legal relationship from the authorized party, who controls or owns the land, to the State.
